People tend to become furious when someone suspected of committing a reprehensible crime is acquitted or receives what most perceive as far too light a sentence. They call the jury a ‘bunch of idiots’ and say that the judge is ‘easy on crime’. Most of all, they accuse the lawyer (usually with language not worth repeating) of whatever bad act comes to mind. He said, “It is better that ten guilty persons escape than that one innocent suffer”. The underlying concept is that the State, with all of its power, should not harm a person because he might be guilty. The Bible (Genesis 18:23-32) expresses the same principal. A dictatorship could be defined as a system which gives all power to the State and none to the individual. Anyone can be jailed or executed at any time. This is not a world we want to live in. The right to legal representation for ANYONE protects ALL of us from the crushing power of the State.
The Sixth Amendment to the U.S. Constitution spells out the rights of the accused as a protection against the State. Miranda warnings, given to criminal suspects by the police, warn suspects that anything that they say can and will be used against them. Both the Sixth Amendment and Miranda warnings guarantee the suspect’s right to legal counsel.
